1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of Safety Photo+Video, including the iOS app, Android app, website, support services, cloud backup features, subscriptions, and related services provided by Sixbytes ("Safety Photo+Video," "we," "us," or "our").

By downloading, accessing, subscribing to, or using Safety Photo+Video, you agree to these Terms. If you do not agree, do not use the app or service.

2. The Service

Safety Photo+Video helps you protect selected photos and videos on your mobile device. The app may include local vault features, encrypted backup, sync, restore, account management, storage management, subscription features, support tools, and related privacy and security controls.

The service is designed for personal photo and video protection. It is not intended to be a regulated records system, medical archive, legal evidence repository, emergency backup service, or the only place where irreplaceable files are stored.

  • Backup and restore may require an account, active subscription, storage allowance, network access, and device permissions.
  • Large libraries, videos, poor connectivity, low device storage, or platform limits may affect backup and restore times.
  • Some features may differ between iOS and Android because of platform capabilities and store requirements.

3. Eligibility and Accounts

You must be at least 13 years old, or the minimum age required in your country, to use Safety Photo+Video. If you use the service on behalf of another person or organization, you represent that you have authority to accept these Terms for them.

You are responsible for keeping your account information accurate and secure. You must not share your account with someone who is not authorized to access your protected library. You are responsible for activity that occurs under your account unless caused by our failure to use reasonable security measures.

If you believe your account has been compromised, contact support promptly and change any affected passwords where possible.

4. Encryption Password and Recovery

Important: Your Encryption Password protects your private photo and video library. We do not know it and cannot recover it for you. If you lose it, your encrypted backup may be permanently inaccessible.

You are responsible for choosing, storing, and protecting your Encryption Password and any recovery information. We recommend storing it in a trusted password manager or another secure place before relying on encrypted backup.

  • Do not send your Encryption Password to support, email, chat, screenshots, or social media.
  • Support can help with account, subscription, app, backup, and restore issues, but cannot decrypt your protected library.
  • If you reset or replace encryption credentials, existing encrypted data may become inaccessible unless the app specifically supports migration.
  • Anyone with your account access and Encryption Password may be able to restore or view your protected library.

5. Your Content and Ownership

You keep ownership of the photos, videos, metadata, albums, and other content you place in Safety Photo+Video ("User Content"). We do not claim ownership of your User Content.

You grant us a limited license to host, store, transmit, back up, restore, process, and display User Content solely as needed to provide and support the service. For encrypted protected media, this usually means we handle encrypted backup data rather than readable photos or videos.

You are responsible for making sure you have the rights needed to store and back up your User Content. Safety Photo+Video is a privacy tool, not a license to store unlawful or harmful material.

6. Acceptable Use

You agree not to use Safety Photo+Video to create, store, back up, transmit, share, or restore content or activity that:

  • violates any law, regulation, court order, or third-party right;
  • exploits, harms, or endangers minors in any way;
  • contains non-consensual intimate imagery, threats, harassment, or stalking material;
  • infringes copyrights, trademarks, privacy rights, publicity rights, or other rights;
  • contains malware, spyware, credential theft, or code intended to harm systems or users;
  • attempts to bypass storage limits, rate limits, authentication, billing, or security controls;
  • interferes with the service, infrastructure, app stores, or other users.

Because protected media may be encrypted, we may not be able to review content directly. We may still act on account-level signals, reports, legal notices, platform requirements, storage abuse, payment fraud, or other evidence of misuse.

7. Subscriptions, Purchases, and Refunds

Some Safety Photo+Video features may require a paid subscription or in-app purchase. Plan availability, storage limits, prices, trial periods, billing intervals, taxes, and features may vary by platform, country, app version, and promotion.

  • If you subscribe through the App Store, Apple handles billing, renewal, cancellation, and refund requests under Apple's terms.
  • If you subscribe through Google Play, Google handles billing, renewal, cancellation, and refund requests under Google Play's terms.
  • Subscriptions may renew automatically unless cancelled before the renewal date through the platform where you subscribed.
  • Deleting the app may not cancel a subscription. You must cancel through the App Store, Google Play, or the relevant billing settings.
  • If a payment fails, expires, is refunded, or is reversed, we may reduce, suspend, or end paid features after any required notice period.

8. Storage Limits, Backup, and Data Loss

You are responsible for maintaining your own copies of important photos and videos. Safety Photo+Video is designed to help protect your media, but no app, device, network, cloud provider, or encryption system can guarantee that data will never be lost, delayed, corrupted, or inaccessible.

  • Backup may pause or fail if permissions are removed, connectivity is poor, storage is full, battery settings restrict the app, or your subscription changes.
  • Restore may fail if you use the wrong account, lose your Encryption Password, lack storage space, or interrupt the restore process.
  • We may apply storage limits, file size limits, bandwidth limits, retention rules, or fair-use controls.
  • If your account is inactive, unpaid, over quota, or terminated, encrypted backup data may be deleted after notice where required.

9. App Permissions and Platform Terms

Safety Photo+Video depends on iOS and Android permissions for features such as photo library access, camera capture, notifications, network access, and local storage. If you deny or remove permissions, some features may not work.

Your use of the iOS app is also subject to Apple's applicable App Store terms. Your use of the Android app is also subject to Google Play's applicable terms. Apple and Google are not responsible for providing support or maintenance for Safety Photo+Video except as required by their own terms or applicable law.

10. Privacy

Our Privacy Policy explains how we handle information, including account data, app permissions, encrypted backup data, diagnostics, subscriptions, support messages, retention, and deletion requests. By using Safety Photo+Video, you agree that we may process information as described in the Privacy Policy.

11. Intellectual Property

Safety Photo+Video, including the app, website, design, software, logos, text, graphics, and related materials, is owned by Sixbytes or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Safety Photo+Video for its intended purpose. You may not copy, modify, reverse engineer, sell, rent, sublicense, or create derivative works from the app except where permitted by applicable law.

12. Updates and Changes to the Service

We may update, modify, suspend, or discontinue features at any time. Updates may be needed for security, compatibility, platform requirements, legal compliance, performance, or new functionality. Some updates may change how backup, restore, encryption, subscriptions, or storage features work.

13. Suspension and Termination

You may stop using the service at any time. You may request account deletion through the app where available or by contacting support.

We may suspend or terminate access, remove entitlements, limit storage, or delete data if:

  • you violate these Terms or applicable law;
  • your account is used for abuse, fraud, security attacks, or prohibited content;
  • payment fails, is reversed, or your subscription ends;
  • we must comply with law, court order, app store policy, or platform requirement;
  • continued service creates risk to users, infrastructure, or the business.

After termination, your right to use the service ends. We may delete encrypted backup data and account records according to our Privacy Policy, retention rules, and legal obligations.

14. Disclaimers

To the maximum extent permitted by law, Safety Photo+Video is provided "as is" and "as available." We do not promise that the service will be uninterrupted, error-free, secure from every possible threat, compatible with every device, or able to recover data in every circumstance.

We do not provide legal, compliance, archival, medical, forensic, or emergency storage advice. You are responsible for deciding whether Safety Photo+Video is suitable for your needs and for maintaining additional backups of important files.

15. Limitation of Liability

To the maximum extent permitted by law, Sixbytes and Safety Photo+Video will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, lost data, business interruption, device issues, or inability to access encrypted content.

To the maximum extent permitted by law, our total liability for any claim relating to the service will not exceed the amount you paid for Safety Photo+Video during the 12 months before the event giving rise to the claim, or USD $100 if you paid nothing.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Sixbytes, Safety Photo+Video, and our affiliates, officers, employees, and service providers from claims, damages, liabilities, losses, and expenses arising from your User Content, your use of the service, your violation of these Terms, or your violation of law or third-party rights.

17. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the app, website, email, or another reasonable method. Continued use of Safety Photo+Video after updated Terms become effective means you accept the updated Terms.
